What is the Trademark?
A trademark is generally a word, phrase, symbol, or design, or a combination of these elements,
that identifies and distinguishes the source of one party’s goods from those of others. A service
mark is the same as a trademark except that it identifies and distinguishes the source of a service
rather than goods. The terms “trademark” or “mark” are commonly used to refer to both
trademarks and service marks. Although federal registration of a mark is not mandatory, it has
several advantages, including notice to the public of the registrant’s claim of ownership of the
mark, a legal presumption of ownership nationwide, and the exclusive right to use the mark on or
in connection with the goods and/or services listed in the registration.
Why register a trademark?
Although it is not mandatory to register a trademark in order to use it, trademark registration
adds great value to a business. The goodwill and reputation of a business can be reduced or
tarnished if others try to misrepresent their own goods and services as yours by adopting a brand
that is similar or identical to your business. Some of the key benefits of registering a trademark
include:
• The trademark owner has the right to prevent others from using a similar or identical
mark without his permission once the trademark is registered.
• Generates a rightful perception among the public about the authentic ownership and quality
of the product.
• Prevents others to copy and use the trademark as the owner of a registered trademark can
sue and collect damages from organizations that infringe upon the trademark.
• A trademark registration decreases the likelihood of another party claiming that your
trademark infringes upon their trademark.
• Gives owner the right to use ® symbol.
• It provides a due warning to interested parties who wish to file a similar or identical
trademark since the Singapore trademark office will refuse to register any confusingly similar marks.
In addition, your mark will appear on the local Trademarks Register when businesses contemplate
adopting a mark that is similar to yours.
How to Register Trade Mark in UAE?
Ministry of Economy is the competent authority to register trademarks in the UAE. To register a
trademark, customers can submit an online application via the ministry’s website. Registration
documents include:
• Trademark logo
• A copy of the commercial license
• Power of Attorney (if there are more than 1 partner in the license)
• Passport copy
• English &Arabic Description of Trademark
Registration: Online
Timeframe: 6-7 months
Process:
• Submit the application
• M. Economy will study the application- 1-2 months
• Once Post Study approved, pay for publication in 2 national newspapers
• Publication period 2-3 months
• Post-publication &Approval period: 2-3 months
