DED e-trader license:

is the most cost-effective license you can get in the Emirates.

It is suitable for self-employed people, freelancers and stay at home people, however it is not suitable for everyone and any activity – it depends on multiple factors, mainly on the business activity and also there are some restrictions that you might not be aware of.

That’s why, below, we want to bring some clarity on what exactly is a DED e-trader license and more importantly what it isn’t.

Called e-trader, meaning “online trading”, this platform was not created initially with openness for foreigners registration. The DED e-trader license was initially available for UAE and GCC nationals and included a lot of options: professional, services and also trading – such as fashion trading, electronics trading, manufacturing trading, all sorts of trading activities – “trading” meaning buy-sell of goods which has been available to the UAE and GCC nationals in the past. ded freelance license

In 2018, DED e-trader was made available by the Dubai Economic Development (DED) in Dubai for the foreigners (expats that are non GCC and non UAE nationals) but without the trading part, because the commercial companies law till date requires a commercial and industrial activity to have a 51% nominal or active UAE national shareholder.

The DED e-trader license at the moment is an online platform that gives you a mainland license with a 100% foreign ownership for services and professional activities only.

You cannot take a DED e-trader license and practice a commercial activity or buy in wholesale and sell retail, buying items, repurposing them and selling them. It is allowing people to provide, let’s say – handicraft workshop services such us (imitation jewelry smithing, creating a sculpture, producing arts – such as paintings, frames, engraving different types of products to personalize them), but it does not allow you to sell with those goods (specifically to buy them from producers or wholesalers and retail them).

DED e-trader license it’s called “e-trader”, but it does not have trading and commercial activities available for foreign expatriates (non GCC and non UAE nationals).

A lot of people will debate, but DED e-trader says “I can sell my handicrafts” which is true, but it means that you have to produce that handicraft from scratch yourself (you will take the clay – you will make out of it a sculpture and you sell the sculpture; you will take a textile of whatever nature – you will tailor it and make one custom made to the person tailored dress or crocheted item and then sell it via social media platforms or directly on delivery).
But you have to do it 100% with your own hands as a handicrafted item. You cannot sublease these services further. The DED e-trader is an online license, with a 100% foreign ownership, for professional and services activities only, that allows you to have a mainland license without limitations of operations within Dubai, but it does not allow to have a commercial activity under it.

Kellie: for example: I am a photographer, with my own camera and I take a photo, can I sell it to you?

There are 2 types of activities in the photography industry on the DED e-trader platform available for foreigners: one is Commercial Photographs Production and the other one is Consumer Photographs Production.
So, if you are taking the Commercial Photographs Production activity and you are making those photos with your ownership, you are allowed to sell the rights of those images to third parties, but you have to have produced them and of course you have to make sure that those photos do not reflect areas of the city (that are regulated by the government rights). For example you take a photo with Burj Al Arab and sell it with your own rights – which is unfortunately not allowed due to the symbol of the building itself.

Kellie: But we’ve seen so many pictures with brides and grooms in front of the Burj Al Arab or Burj Khalifa.

“Selling the item” and “Providing the service” has to be separated.

On Commercial Photographs Production you are shooting photos and you are giving the rights to people to buy those photos and use them in media, newspapers, magazines, online, websites, etc.

Standalone points of the country that are regulated by the Tourism Department are not to be taken.

Taking a photo as a service, and now we are moving to the other activity which is Consumer Photographs Production – in that instance the photographer is not the owner of the picture, I am the owner of that photo as the groom or the bride and I pay for the services, not for the photos. So, the photographer does not keep the ownership in front of the law as a product and does not keep ownership over images when they are done on an event (wedding, party, entertainment event, etc.).

Kellie: So basically, with a DED e-trader license you can take a photo of me on my wedding day in front of Burj Al Arab – I pay you for those services of being my wedding photographer, I then own those photographs?

Yes!

Kellie: Brilliant!
What about fitness activities?

Anything regarding sport professionals such as nutritionist, fitness personal trainers, yoga/pilates instructors, swimming classes and so on and so forth are now regulated by the General Authority of Youth and Sports Welfare, and unfortunately no sport activity is allowed on the DED e-trader platform for foreigners. For UAE nationals is different and they do have some activities available to them, but for expatriates of non GCC and non UAE nationality – no sport activity is allowed under the DED e-trader.
All sport activities are regulated by the General Authority of Youth and Sports Welfare and people who want to operate, must obtain the relevant permits due to being a highly regulated activity.

Kellie: What about business consulting? It depends on the activities, and is it similar to what you just said regarding the coaching activities? General advice rather than bespoke/personalized advice??

Depends on the industry, with consulting in general – the consultancy activity especially in Dubai is seen as regulated and whoever takes any type of consultancy services license needs to pass an exam in the American University in Dubai, which is a general 75 questions exam proving general knowledge of economics.  

In order for you to be a consultant for HR, marketing, business development – you need to prove to the authorities that you have the expertise, the knowledge, the diploma, the studies and professional experience to become a consultant in that field.

When we use the word “consultancy” as itself management consultancy or marketing consultancy – it is a regulated industry and it is not available in the DED e-trader license because it requires the side approvals.

But when we look from the execution point of view – if you are for example a project manager – does this include that throughout managing that project you can advise the client on how to make it better, how to implement it and help them implement it? Of course, yes. And Project Management activity is available under the DED e-trader license –

but you’re seen more as an executor, you are managing that project and throughout managing that project (talking in general) of course with exceptions of regulated projects (medical, construction, engineering or oil) talking about (for example) – event industry or any other industry that has overall projects of development – were you can participate and give advice, but you are not officially a consultant – you are an executor of the project with your knowledge and expertise as well.

Also marketing services – that is an activity available or marketing management available under the DED e-trader platform – you are managing a company’s marketing presence, offline as well as online presence – this does not mean that you cannot advice the client out of your expertise how to improve that marketing platform of structure, but it means that you cannot position yourself as a consultant and charge for consultancy fees.

The consultancy or the advice comes as a part of your management of their marketing platforms – so this is how it’s seen in the activities.

Kellie: How many activities are available now on the DED e-trader platform?

Around 3000 at the moment

Kellie: I think it’s important to point out also, if you are entitled with the DED e-trader license – how may categories can you get under one license?

As per the general rule in the UAE, specifically in Dubai in the DED you can have up to 10 activities part of the same category. That’s applicable to any type of DED license. In the DED e-trader license, some categories do not even have the opening to 10 activities of that category. An example: you took in the DED e-trader the activity called separate professional activities – that has only 3 activities available in that category under DED e-trader, but it has hundreds of them in a usual licensing platform. So, given the fact that you have the availability of multiple activities, then you can take up to 10 activities part of the same group.
If we look at marketing – we have marketing management, PR, marketing through social media, portal, blogging, website content provider, etc. – so you can add up to 10 activities under the same cost that are part of the same category. You cannot combine under the same DED e-trader license different categories (for example: combining conference organizing and imitation jewelry smithing) as they are 2 separate categories and 2 individual DED e-trader licenses for each separate category must be taken.

Kellie: Can we add more than 10 activities under the same license? Do we have to pay for each additional activity?

Currently in the DED e-trader platform, if you want to change from one category to another, it is the modification fee that you have to pay for.
More than 10 activities under one license though it is not possible at the moment. A duplication of activities is not allowed under the DED e-trader platform – example: you have one portal activity called “Female Fusion” and another portal called “Happiness” – both portals, both owned by the same person. It is allowed to have 2 separate activities, example: one “portal” activity called “Female Fusion” and another activity “imitation jewelry smithing” (both different and separate activities) that can have the same name or different.

Kellie: Is the DED e-trader covering only Dubai or is available all over UAE?

As per the commercial company’s law that regulates at the federal level the operations of a commercial entity – DED e-trader is a license from Dubai Mainland and by general rule any company should operate within the emirate where the license is from.
So if you officially would like to operate in any other emirate, then legally you should have a license from that specific emirate for that scope of work.

Kellie: Going back to the marketing and social media activity, blog content, etc. does it include influencers as well or this is a regulated activity by the National Media Council and the license will cost more?

Influencer’s activity is seen as a freelance individual structure which does not come under the DED e-trader platform, because they receive income not from the handicraft or their own skills, but from selling media exposure. That is a separate category which is not covered by the DED e-trader platform and they have to be of course licensed with National Media Council as well as get the relevant freelance permits.

Kellie: What about web development? Does it come under the DED e-trader platform?

Yes, website design, web pages content, graphic design of the website are the activities available under the DED e-trader platform.

Kellie: Pet trading? Is is included in the DED e-trader?

Anything animal related activity is regulated by the Animal Welfare Department either by the municipality or MOCCAE which is UAE Ministry of Climate Change and Environment. The training activity itself exists in the DED systems and platforms, but it doesn’t exist in the DED e-trader platform unfortunately, because the person who would become a trainer have to show qualifications and knowledge of handling animals.

Let’s summarize the DED e-trader in 3 general questions that everyone can ask themselves before deciding to get the license:

  1. Do you think it is mandatory to have studies, to have some experience or just anybody can just start and from tomorrow provide that service?
    We are not talking about the skill set, we are talking about the consultancy, advisory and management. So, if worldwide your activity is “trainer” (to be a trainer you need to be licensed even abroad, you need to have a relevant degree) – it needs to have a qualification and a regulated license as well. It has to be approved by the government, it has to be verified and it cannot be a license issued online in 5 minutes with a click of a button.

2. Can I provide this service 100% by myself or can I produce this product from scratch 100% by myself? Or do I need to subcontract parties or sublease some of the services or part of the product or process? If you answer yes – I can produce it from scratch and repurpose it 100% – for example: buying clay and selling a sculpture out of it in any type of handicraft, then yes.
The license is for you if you can do it 100% and you repurpose the item, not just improve it.

3. Third question, very common one – mostly related to the operational side, would I need to get employees and grow the business and get a visa or not – immediately (talking about short term)? DED e-trader license does not offer visas, if you do need employees under this license – let’s say 3,5 months, half a year or short term – this is not the right license for you.

You cannot sponsor anybody under the DED e-trader license – it’s a 100% based on your residency.

Ask yourself at least these 3 questions, if they make sense to you, then you’d know if this license is suitable for you.

Kellie: Can I subcontract part of my business?

Once again, is what the client is paying you for. If your client pays you for the design services, the activity is available under the DED e-trader platform and you are just charging for the design. The item itself that it’s been produced by a tailor-shop of a manufacturing line is actually sold by the tailor-shop or manufacturing line to the client. So, you are not selling the item, you are providing the service of designing.
Or you are creating the design of the business card, but then the printing press is going to sell the business cards printed (as a final product). Same for the clothes – I’m creating the design of it, and you are buying the service of the creativity of that design, and then putting specimens and specifics in place, but then the item itself is being sold by the producer (manufacturing line or the tailor-shop). If I’m selling you an already made garment made by that producer, it means I’m not selling you the design, I’m selling you the ready-made dress, even though I designed it, you are paying me for the dress – so that’s a trading experience then.

Kellie: There was another example – selling diaper cakes or gift baskets? By taking the products from elsewhere and putting them together into your gift or diaper cake – meaning that you are trading in diapers then/you are trading in goods and not actually selling a service..

Ok, let’s take it this way – when I’m invoicing you as a client, I’ve made the cake out of diapers – in that invoice do I charge you only for the hourly rate for making the cake, or do I charge the value of the diapers plus the effort? So, you have the value of the diapers, it means I’m selling the diapers along with the time I’ve taken to put it into a cake or make that beautiful decoration,

so in that instance I’m trading with the good itself. You have gift basket – you’ve assembled it with some glitter, flowers and some chocolate and some glue, scissors, etc. – have I produced that glue and scissor from scratch, from zero? If not, it means I’m taking ready made goods and I’m selling them, but I’m just adding on top efforts of making it look good or rearranging it. In that instance, it is a trading activity.

Kellie: Which categorically does not come under the DED e-trader license?

No

Kellie: Expanding on the tailoring example, if I want to design and stitch the dress and sell it to you, would that be allowed?

How about we do a crocheted hat, I’m going to buy the thread, and the thread itself will cost me roughly 4 AED. Then I make it into a crocheted hat and I’m going to sell it for 35 AED (for example). Why? Because it’s the time, the effort and the final product that has to be used. I’m not selling it as a thread. I’ve made it 100% by myself, the final product was created from scratch 100% by me. It’s the same with the dress: I took a piece of material, I didn’t sell it as a piece of material. Like I took a diaper, I sell it as a diaper? I stitched the dress, I rearranged it, I added buttons, I hand-crafted it with my own hands, and that dress can be sold under the DED e-trader license.

From this aspect the DED e-trader license is so affordable, because the government understands that only you as a person do 100% of the work (which is not as easy and as fast as a manufactory or a company with many employees – for example).

How many pieces physically per day they can create? Are they going to create 100,000 pieces per day? Obviously not!

It’s obviously a low volume of selling your own handmade goods.

Another example, I’m buying a hat from Bali, I’m just adding a decoration to it or personalize it and then sell it. In this case it is trading. Only if I produce those hats myself from scratch and then sell them, I’m allowed to be under the DED e-trader platform.

A simple example on the personalization on the DED e-trader is the engraving services which are available, but then trading with gift goods is not available. So, you can have your pen, give it to me, I’ll engrave it and charge you for it and I’ll give you your pen back, but I’m not allowed to sell you a pen with the engraving on it.

Kellie: What about personalized items: t-shirts, coffee mugs, cushions etc. – can I sell a t-shirt with my design on it and be licensed under the DED e-trader license?

No

Kellie: But I’ve made it myself

Yes, but you’re in need of the coffee mug, t-shirt or printing service. Under the DED e-trader platform you can’t sell the personalized coffee mug, t-shirt or cushion, but you can provide the service of the personalization design itself.

You are allowed to sell them as products only if you stitched the t-shirt, created the mug from scratch and painted them with your own hand.

Kellie: Are bank accounts allowed under DED e-trader license?

Provision of the law says that DED e-trader license is a business license and nobody says you’re not allowed to have a DED e-trader business bank account. But it is at the discretion of the compliance team at the bank to see if you are a high risk or low risk business model, if you are showing proof of funds and secure the continuity of the business. Also, it is not illegal to have a DED e-trader license and operate from your own private bank account, given that you are the 100% owner and sole liable for that license, the only concern you have to have is of course the bank account that services your private bank account permitting to operate commercially from that bank account. Some banks allow you to have a commercial operation and some don’t.

!!! RECENT UPDATES from the DED: The coaching activity has been suspended recently from the DED e-trader & Instant license platforms, therefore it’s no longer available.

    Good morning ladies, do you know whether this ESR (Economic Substance Regulations) form – which apparently needs to be addressed by all businesses in the UAE, mainland & free zone by 30.6.20 – is applicable to the holders of a DED etrader licence? The licence from the DED Cafe, not the full DED licence? I can’t find an answer to this question anywhere.

    Thank you for this detailed post, it clarifies a lot of things. However, I do have one doubt – I purchase handbags and handpaint them with my own designs or customize them for a particular order. I do not sell non-painted bags, but I don’t make the bags myself.
    I also intend to take shoe-painting & bag-painting workshops with all materials included from my side.
    Am I eligible for the DED e-trader license? If yes, could you help me with the category? And if not, what kind of license is applicable for something like this?

      Catering and food preparation is a highly regulated activity and requires commercial premises. Preparing food at home is not permitted under the UAE commercial law. DED e-trader license unfortunately doesn’t cover this activity, even though it is 100% handmade.

In your case, the relevant license would be an instant license with the activity: Animals Requisites Trading and the cost will be approximately 25,000-30,000 AED.

    I am a GCC national and planning to register a DED e-Trader license, I print on already manufactured clothing and design home objects/accessories, wall prints and artwork. What would be the activity I fall under?

    I also noticed that part of the policy is that the activity should be included in your company name (example if I sell Gifts, I should name the company XYZ Gifts) Is this correct and mandatory?

    Also on another note, my sister (GCC national as well) is considering starting a home catering business and selling online…what category or activity would she be considered under?

    Is there a list of e-Trader commercial activities list to refer to?

        · A trade Mainland license (complete license) with a UAE local sponsor which will have a 51% stake of the company – that will allow you to have no limitation within the UAE market;
        · A Freezone license that will restrict you to that specific Freezone, otherwise a UAE local distributor must be appointed to be able to trade on the Mainland.

    I am an artist but never sold any works of mine till now as I am working for a company.
    My 1st query is, if I want to sell my paintings through online platforms like Etsy, Art platforms, and also on my own website (I will get my website created as well once I get clarity) Can I do these through e-trading license from Dubai? upon selling any of paintings, will be required to pay VAT?
    2nd query, Do I need to have an NOC from my existing company who is my sponsor in UAE for this? If yes, then I am sure they will not give an NOC, therefore shall I opt for a UAE resident visa on my own as well? Should it be a freelance visa for Artists?

You can order materials from a mainland importing trading company in the UAE. You can sell the handmade items (made by you from scratch) without any limitations, online. As the license is obtained from mainland, it allows to sell all across the UAE and internationally, including Europe. E-trader license allows trading/reselling activity to Emirati and GCC nationals only.

They said I can have a licence to hold workshops but will need a food permit from Dubai Municipality. Ive contacted DM and they have sent me round in circles. Would the E Trader license cover our small home based handmade custom pieces for sale online and/or say at the Ripe/Arte Markets for example . for example I take raw wires , and say a rose quartz stone . I then spend hours designing, creating weaving, coiling and working the wire to create a beautiful designed pendant or earrings etc. Would this license cover the sales of these items At markets, online and trough IG/Facebook?

    My transactions will not be more than 180000 aed for sure am i exempted from tax.

    I would like to get the DED e-trader license, to sell my own crafts. My visa is sponsored by my parent (I’m a foreigner), on the visa it says ‘profession: student / not allowed to work.’ I assume this is the same for anyone who is sponsored by family. Does this mean I cannot stay on this visa? What if I want to get a freelance or a business license later, will I need to change this visa?

    Thank you for the all the great detailed info regarding the DED E-trading license. I have a question though that I am confused about.

    For a freelance musician artist (who is currently not holding a freelance license) but holds a Golden Visa – are they allowed to continue providing their services by playing music for entertainment purposes in venues around Dubai?

    If not, bearing in mind that the artist promotes their services on social media platforms, does the DED E-trade license allow the artist to provide their services and what category would it be under?

    And if so, does the DED E-trading license issue necessary paperwork when applying for a Schengen Visa for instance.

    Visa applications require proof of income as either Salary and NOC letters which is difficult to some freelancers.

    That is my main reason for applying for this license. How can I solve these issues through the DED E-trading license.
